Election Integrity Update - 5/31/2025
On last week’s Election Integrity Update, Jay DeLancy and Janet Fenstermaker from the North Carolina Voter Integrity Project joined us to explain the Department of Justice (DOJ) lawsuit against North Carolina to compel compliance with the Help America Vote Act to clean their voter rolls and give us background details on how they supplied the data to the DOJ.
We discussed the Fulton County Board of Commissioners May 21st decision to reject the Republican Party nominees but accept the Democrats Party’s nominees to the Board of Registrations & Elections and highlighted some of the supporters who gave public commentary to the commissioners.
Garland also provided a VoterGA legal update regarding the ballot image destruction case. The June 5th hearing for the case in the Coweta Superior Court was postponed to August 19th. Stay tuned!

Election Integrity Update - 5/17/2025
On last week’s Election Integrity Update, Garland Favorito gave revisited highlights of the State Election Board meeting on May 13th and May 14th including an update on the SEB’s decision on Dan Gasaway’s complaint regarding district boundaries and the DeKalb case involving the tabulator failure in the 2022 Primary.
Now that the May 14th deadline for the governor to sign or veto bills has passed, Tania Sosa reviewed the new laws as result of this session’s election integrity legislation and bills that the Constitution Party of Georgia featured.
Marci McCarthy gave us details on her new appointment as Director of Public Affairs at the Cybersecurity and Infrastructure Security Agency (CISA). She also addressed Georgia’s 2026 Election Readiness: Legal Gaps, Risks, & Next Steps.
Marci updated us on the DeKalb GOP’s request to the federal Department of Justice to formally intervene in the DeKalb GOP v. Raffensperger case over Georgia’s reliance on an insecure voting system. And activist Gail Lee from DeKalb County informed us of some of her recent ineligible voter registration challenges.

And Tania Sosa gave us an overview of UOCAVA (Uniformed and Overseas Citizens Absentee Voting Act) voter registration laws in Georgia.

On last Saturday’s Election Integrity Update, Garland Favorito reported on the court rulings on the lawsuits filed against provisions in President Trump’s Executive Order 14248 “Preserving and Protecting the Integrity of American Elections”. And Tamara Favorito discussed the facts and dispelled the myths about H.R. 22, the SAVE Act.
Many of you have reached out to the State Election Board regarding SEB2018-104, former State Representative Dan Gasaway’s 2,300-day old complaint filed in 2018 in which he exposed alleged intentional districting inaccuracies impacting the Georgia House District 28 and other local races. And thanks to those who have reached out the Board will hear the case on May 13. Dan provided a recap on the case and filled us in what the State Election Board has disclosed so far of their investigation.

On last Saturday’s Election Integrity Update, VoterGA reported on the outcome of election integrity legislation after sine die and informed us of the tentative plan to achieve legislation so that Georgia’s election complies with President Trump’s Executive Order and SB189 from 2024.
As one of the plaintiffs in the Curling case, I shared my reaction to Judge Totenberg’s shocking order to dismiss the case after seven years and discussed my legal options. Garland and I revisited highlights of the seven-year-long case and some of the research we were able to put in the court record.

We had an action-packed week for Election Integrity! On last Saturday’s Election Integrity Update, we discussed the impact of President Trump’s Executive Order Preserving and Protecting the Integrity of American Elections. We discussed where all our election integrity objectives stand, reviewing all the relevant legislative activity at the State Capitol, and highlighted the passage of SB 214 in the Senate Ethics Committee, which includes a provision for hand-marked ballots!
Here’s what you can do to help us achieve our election integrity goals before sine die – the end of the legislative session – on April 4th.
CALLS TO ACTION
SB 175 is the election integrity omnibus bill for 2025 in the House with many good provisions, including banning ERIC and making the State Election Board independent of the Secretary of State. It needs to pass to the House Floor for a vote. Please call and email House Rules Committee Chairman Butch Parrish and Vice Chair Rob Leverett, Speaker Jon Burns and Governor Kemp TODAY and ask them to pass SB175 to the House Floor for a vote. HB 397 is the election integrity omnibus bill for 2025 in the Senate with many good provisions, including banning ERIC and giving the State Election Board more authority. SB 214 is our bill for Hand-Marked Paper Ballots for the 2026 election. It unplugs the BMDs and replaces them with Ballot On Demand printers. Please call and email Senate Rules Committee Chairman Matt Brass, Vice Chair Ben Watson, Lieutenant Governor Burt Jones, and Governor Brian Kemp TODAY and ask them to pass SB214 to the Senate Floor for a vote as soon as possible. On last Saturday’s Election Integrity Update, we heard VoterGA's legislative update and Garland discussed the advantages of hand-marked paper ballots, the advantages of publically recorded hand counts, and banning ERIC. In addition, Dr. Rick Richards reviewed his astounding findings on votes cast for ineligible voter registrations in the 2024 election.
The Senate Ethics Committee scheduled a hearing of a substitute to HB397 on Tuesday, March 25th at 1 p.m. in 307 of the Coverdell Office Building. The substitute bill may contain provisions for:

Hand-marked paper ballots,
- Banning ERIC to protect the personal information of voters and drivers from being disclosed to third parties,
- Grants of more authority for the State Election Board to ensure the integrity of our elections,
- Possibly even hand-counting ballots to ensure the security and integrity of the vote count.
We are asking everyone to show up for this meeting and please feel free to wear your VoterGA gear in support of HB397. We will know which provisions will be included in the bill on Tuesday. If you choose to speak, we have included positive, non-partisan talking points that you can click on for Hand Marked Paper Ballots, Hand Counting, and Banning ERIC.
The House Judiciary Non-Civil Committee is scheduled to hear SB244 for recovery of attorney fees and costs in case of prosecutorial misconduct on Tuesday at 3:00 p.m. Click to ask Chairman Tyler Paul Smith to call for a vote on SB244.

Jason Frazier briefed us about Wednesday’s hearing at the Georgia House Governmental Affairs Committee where Jason (click here for slides), Mark Davis, and Rick Richards presented various issues with the list of eligible Georgia voters. And Laura Scharr from South Carolina Safe Elections informed us about Congressman Pete Sessions’ proposed Make Elections Secure Act.
