FOR IMMEDIATE RELEASE June 28, 2003 National Contact: Laurel Lynn Constitution Party National Office 717-390-1993 or at hq@constitutionparty.com State Contact: Ricardo Davis Constitution Party of Georgia 770-924-8546 or at ga@constitutionparty.com CONSTITUTION PARTY: DENOUNCES COURT DECISION, SEEK IMPEACHMENTS The Constitution Party is the first national political party to denounce the recent Supreme Court ruling that threw out a Texas law that made sodomy a crime, and called for Congress to draw up articles of impeachment against Justices Kennedy, O'Conner, Breyer, Souter, Ginsburg, and Stevens. "This ruling is, in itself, unconstitutional and an affront to the United States Constitution and the people of the various states, and those members of the court who supported it should face the consequences of their blatant lack of Fidelity to the Constitution they took an oath to uphold." said James N. Clymer, Chairman of the Constitution Party National Committee. Clymer said that the constitutional problem with the ruling is the fact that the Supreme Court willfully chose to ignore the 10th Amendment. "The 10th Amendment is very clear that unless the Constitution specifically delegates authority to the federal government then all other powers are reserved to the States and to the people," Clymer said. "In other words, if a state is exercising a power not prohibited to it in the Constitution, then the court is supposed to maintain a hands off attitude," he said. "This court, however, deliberately chose to take upon itself the role of an activist court, meddle in the affairs of an individual state, and, consequently, crush the powers of the people of Texas who elected the representatives who passed this law to begin with," Clymer said. "This ruling is a blatant and dangerous violation of the Constitution." Clymer said that now that the Supreme Court has demonstrated that it is unwilling to restrain itself in accordance with the parameters set out in the Constitution it is the duty of Congress to draw up articles of impeachment against those justices who embraced the Texas ruling. "Justices like Stevens and Souter and Breyer, who are so quick and so willing to ignore the very document that they are sworn to uphold and abide by, have, in this case, demonstrated once and for all that they have no regard for the rule of law and the Constitution itself," Clymer said. Clymer asserted that justices of the Supreme Court do not have life tenure, contrary to popular belief. Rather the Constitution states that they are to serve "during good behavior." The intent of that provision is that they maintain fidelity to the Constitution. Their failure to do so disqualifies them from continued service on the bench. The Constitution Party is the nations third largest political party in terms of actual voter registration. The foundational purpose of the Constitution Party is to restore government to its proper constitutional role and restrain it to its Constitutional limits.
